Terms of Service
Last modified: March 20, 2026 • Effective Date: January 1, 2026
1. Acceptance of Terms
By accessing or browsing the website of Total Tree Maintenance ("Total Tree Maintenance", "we", "us", or "our") at https://totaltreemaintenancellc.info, or by calling our telephone number ((321) 677-9055) to inquire about tree removal, emergency storm work, pruning, or stump grinding, you agree to comply with and be bound by these Terms of Service.
2. Service Estimates & Scopes of Work
Any preliminary discussions conducted over the phone regarding tree service pricing or timelines are non-binding informational guidance. Accurate pricing requires an on-site physical evaluation of tree height, trunk diameter, canopy lean, proximity to structures, overhead utility line paths, and ground access.
Before commencement of any tree cutting, a formalized written scope of work specifying the target trees, pruning parameters, wood haulage, stump grinding depth, and payment terms will be presented to the property owner or authorized property manager.
3. Property Access & Ownership Authorization
The customer certifies that they are the legal titleholder of the real property upon which tree services are performed, or an authorized agent with explicit written permission to contract for tree alterations.
The customer grants Total Tree Maintenance and its equipment operators reasonable access to driveways, yards, and access gates necessary to position bucket trucks, track lifts, chippers, and stump grinders. For trees situated on boundary lines or within municipal road rights-of-way (such as street trees between sidewalks and curbs in Lansing or East Lansing), the customer is responsible for confirming ownership and obtaining necessary municipal forestry permits before scheduled takedowns.
4. Underground Utilities & MISS DIG 811
Prior to any mechanical ground-penetrating activity—including below-grade stump grinding—public utility locating must be completed in accordance with Michigan Public Act 174 through MISS DIG System, Inc. (call 811 or 800-482-7171).
MISS DIG locates public utility infrastructure (gas mains, electric cables, municipal water, and commercial telecom). Private, unrecorded underground lines—such as private low-voltage landscape lighting, invisible pet fencing, lawn irrigation pipes, septic drain lines, or private swimming pool conduit—must be clearly flagged and identified by the property owner prior to work.
5. Severe Weather & Force Majeure
Arboricultural operations are subject to environmental conditions. High winds exceeding safe operating thresholds, severe thunderstorm warnings, lightning, ice accumulation, or deep unplowed snow will necessitate the rescheduling of non-emergency tree work to ensure the life safety of arborists, ground crews, and client structures.
6. Telephone Communications
By calling our published phone numbers, you consent to receive return phone calls and direct communications regarding your estimate request, crew arrival timing, or operational details. Calls may be recorded or monitored for operational verification and dispatcher training.
7. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any legal action or dispute arising under these terms shall be subject to the exclusive jurisdiction of the state or federal courts located in Ingham County, Michigan.
